  • Description: This session explores the massive modernization of the Canadian asylum system under the regulations proposed on June 19, 2026. Designed to improve the efficiency, fairness, and speed of refugee claims, these updates are critical for legal practitioners navigating the current lower-volume but highly scrutinized refugee environment. The course covers crucial temporary public policies, specifically the May 19, 2026 exemption for unaccompanied minors, and the March 26, 2026 policy providing open work permits to claimants whose files are ineligible to be referred to the Immigration and Refugee Board (IRB). We will also examine the inter-departmental MOU between CBSA, IRB, and IRCC, alongside transnational security agreements including the Safe Third Country Agreement and visa information-sharing partnerships.

Learning Objectives:

  • Assess the core procedural changes introduced in the June 19, 2026 asylum modernization regulations.
  • Analyze and apply the May 19, 2026 unaccompanied minors temporary public policy to shield vulnerable children from ineligibility bars.
  • Secure open work permits for out-of-status claimants and ineligible IRB claimants under the March 26, 2026 public policy.
  • Navigate the intergovernmental sharing arrangements under the CBSA, IRB, and IRCC memorandum of understanding.
